How to stay compliant with HIPAA and TCPA guidelines

Providers on a Professional or Clinic plan can send waiting room invitations via text message with the SMS invite option. However, you need to clarify a few things with the patient before doing so:

  • Patient has given their consent to receive SMS messages from the provider OR patient has had a prior relationship with provider.

  • Provider may not send any health information that could be considered PHI (as defined by HIPAA) in the message.

  • Patient must be aware that data and messaging rates may apply to each message sent.

  • Patient is aware of opt-out instructions and support if needed:

    • "Reply STOP to opt out"

    • "Reply HELP for help"

These requirements are needed to stay compliant with carrier regulations.

Once the requirements are met, simply check the box in the lower left corner to start sending SMS invitations:
